To the extent required by the Public Authorities, by specific provisions of law or by FIGC regulations, the processing may also include information relating to criminal convictions and offences or measures in any way prohibiting the purchase of products and services of Cagliari Calcio S.p.A.

4. Purposes of processing: pre-contractual measures - performance of contract - orders by authority

The processing of your personal data is aimed at and necessary for the proper execution of the contract for the purchase of admission tickets (tickets/subscriptions) and/or fidelity cards and/or other services between you and the company Cagliari Calcio S.p.A. The processing is necessary, in particular: to fulfil the pre-contractual, contractual and fiscal obligations arising from the contractual relationship between you and the company Cagliari Calcio S.p.A.; to carry out all the practices provided for by the regulations in force regarding safety in stadiums; to fulfil the obligations provided for by law, by a regulation, by the European Community regulations, by an order of the authority and/or by the FIGC; to protect a legitimate interest of the company and/or to defend a right of the company in court.

The legal basis for processing for these purposes is your consent. This consent is optional and failure to grant it will not prevent the execution of the contractual relationship between you and Cagliari Calcio S.p.A., but only the possibility that Cagliari Calcio S.p.A. S.p.A. to send you material and/or informative/advertising communications deemed of interest. In any event, where you give your consent, you may revoke it at any time, without affecting the legitimacy of the processing carried out up to that point. Passione Casteddu fidelity card terms and conditions

1. Definitions

In these contractual terms and conditions of use ("Terms and Conditions"), the following definitions apply: for "Club" or "Cagliari-Calcio", Cagliari Calcio S.p.A., having its registered office in Assemini (CA), Località Sa Ruina snc. 09032, VAT 00271200925;

"Holder" shall mean the person who, having been duly identified and having completed the PASSIONE CASTEDDU Card subscription procedure (as defined below), obtains the issue of the same. No one may hold more than one Card;

for "Card PASSIONE CASTEDDU" (or simply "Card"), the identification card created as part of a programme of the Ministry of the Interior and established in accordance with the following regulations (DM 15/8/2009, implementing art. 8 D.L. 8/2007 converted into Law 41/2007 - Fidelity Programme ("Tessera del Tifoso" programme) approved on 23/4/2008 by the National Observatory on Sporting Events - Circulars of the Ministry of the Interior dated 14/8/2009, 17/8/2009, 16/12/2009 and 6/8/2010) and evolved following the Protocol of Understanding dated 4/8/2017;

for “Website”, the website www.cagliaricalcio.com;

for “Website TicketOne”, the website www.ticketone.it;

"Contract" shall mean the contract to which each Holder is party under these Terms and Conditions;

for "Ticket Service Unipol Domus", the points where it will also be possible to request the issue of the Card, indicated on the Site;

"Code-of-Regulations" means the Code of Regulations for the transfer of admission tickets to football events;

by "Access Tickets", individual tickets and season tickets for the Club's home matches.

2. Functionality of the PASSION CASTEDDU Card

2.1 Card:

- allows access to more streamlined sales procedures through the transfer of the personal data stored in it directly from the Card to the issuing/release/payment systems, as it is compatible with the ticket sales systems recognisable by any issuer of fiscal tickets (Holders are in any case required to carry and present a valid identity document in the event of any request by the retailer), but does not automatically grant the Holder the right to purchase the individual stadium tickets requested from time to time (this possibility depends on the actual availability of said tickets);

- exempts the holder from the specific restrictions that may be imposed for reasons of public order for matches played in Italy, both home and away, allowing the holder easier access to the purchase of individual tickets for stadium access in the 'guest sectors' in domestic away and/or high-risk matches. Such possible facilities may only be granted by the bodies and authorities responsible for public order and safety;

- streamlines access procedures in the sports facility because it can also be used to verify the correspondence of the ticket holder with the bearer (Holders are in any case required to carry and present a valid identity document in the event of any request by the stewards or police forces);

- is an electronic document suitable for use as a digital medium on which to load Access Cards to sports facilities, allowing the Holder to gain access through automated gates, if any, while not excluding the possibility of being subjected to additional security checks and the possibility of requesting (and the obligation to comply with) the presentation of a valid identity document. The Card does not in itself constitute proof of purchase, even if activated for that purpose, of Access Cards unless the appropriate readers or, in the absence of technological equipment, the appropriate paper documentation, confirm that it can be used;

- does not allow more than one ticket to be uploaded per competition. The uploading of Access Tickets is conditional: (i) payment of the price for the purchase of the Access Ticket requested by the Holder; (ii) the Holder's acceptance of the Subscription Terms and Conditions and/or the General Terms and Conditions of Sale of Tickets; (iii) the Holder's acceptance of the Unipol Domus Regulations and the Code of Regulations (also available on the Site).

- duly loaded with Access Tickets, is a document required to access Unipol Domus. Any other printouts attached to the Card or delivered to the Cardholder (or sent by e-mail) when the Access Ticket is loaded onto the Card only have the auxiliary function of reproducing on paper data (such as: sector, row and seat number) already stored electronically anyway. Such printouts therefore do not necessarily qualify for access.

3. Duration of the PASSION CASTEDDU Card

3.1. The duration of the Card shall be 5 (five) years from the date of issue, which is subject to the signing of the Agreement and the consequent acceptance of these Terms and Conditions, without prejudice to any restrictive measures issued by the public security authorities, even after the date of issue.

4. Fee for subscribing to the PASSIONE CASTEDDU Card

4.1. The fee for issuing the Card shall be Euro 10.00 (ten)
for those who are not Card holders and wish to subscribe
a season ticket for Cagliari Calcio's home matches for the season
2023-2024.

4.2. The fee for issuing the Card will be Euro 20.00 (twenty) for those who are not holders of the Card and do not intend to subscribe to Cagliari Calcio's home matches for the 2023-2024 football season.

4.3. Persons under the age of 12 who wish to subscribe to the Card may do so exclusively at the Cagliari 1920 Stores at the special price of Euro 5.00 (five).

4.4. All fees are inclusive of VAT.

4.5. The payment of the Card subscription/renewal fee must be made online on the TicketOne website, by credit card, or in cash in case of subscription at the Unipol Domus Ticket Service (Mon: 9.20am-12.30pm; Wed: 3pm-6pm; Fri: 9.30am-12.30pm and 3pm-6pm).

5. General rules for the use of the PASSIONE CASTEDDU Card

5.1. Card PASSIONE CASTEDDU is strictly personal and non-transferable, however, the Access Tickets loaded in it may be transferred to other parties, provided that they too are holders of another Card, in accordance with the specific procedures established by the Club, it being understood that the transfer is in any case subject to any limits imposed, even on the occasion of individual matches, by Cagliari Calcio and the competent authorities.

5.2. The holder is obliged to keep the Card PASSIONE CASTEDDU and to take every diligent precaution to prevent the document from being used by other persons as an Access Ticket to Unipol Domus. In the event of theft or loss of the Card, the Cardholder shall notify the Club immediately. The stolen or lost Card may be replaced upon presentation to Cagliari Calcio of the report and upon payment of the amount of Euro 10 for the issue of the replacement Card.

6. Information directed to the conclusion of the Contract

- in the event of an online subscription through the TicketOne website, you must register on the TicketOne website, complete the subscription procedure by entering your complete and truthful personal data and the required documents, and make the payment by credit card. In this case, the Cardholder will have to choose whether to physically collect the Card at the Unipol Domus Ticket Service (Mon: 9.20am-12.30pm; Wed: 3pm-6pm; Fri: 9.30am-12.30pm and 3pm-6pm), or to receive the Card by courier directly to the shipping address provided at the time of purchase (in this case, the Cardholder will be charged the shipping cost of the Card, as communicated by Cagliari Calcio on the Website). The compilation of shipping data is done directly by the Holder, therefore Cagliari Calcio cannot be held liable for non-delivery in the event of incorrect data entry. The Card shall be delivered to the shipping address within a non-essential period of 30 (thirty) days from the conclusion of the Contract. Cagliari Calcio shall not be liable for any delays in the delivery of the Card that are not attributable to it or generated by malfunctions in the service by the courier or by force majeure;

- In the case of subscription at the Unipol Domus Ticket Service (Mon: 9.20am-12.30pm; Wed: 3pm-6pm; Fri: 9.30am-12.30pm and 3pm-6pm), you will need to go in person, with a valid ID (or health card, in the case of holders under 14 years of age), to the Cagliari 1920 Stores indicated on the Site, where personal data will be physically collected by the Club, in compliance with current privacy regulations.

6.3. In any event, at the time of signing, the person interested in signing the Card must self-certify that he/she is not the addressee of measures referred to in art. 6 of the law of 13 December 1989, no. 401 (prohibition of access to places where sporting events are held) or pursuant to Legislative Decree no. 159 or as referred to in Law no. 1423 (preventive measures against persons dangerous for security and public morality) or that he has not in any case been convicted, even with a non-definitive sentence, of offences committed on the occasion of or in connection with sporting events;

6.4. However, the Card may not be issued in the following cases:

- partial or non-completion of the subscription process, or

- verification, through the computerised system referred to in the Decree of the Minister of the Interior of 15 August 2009, of the existence of 'obstructive reasons', or

- persons subject to a DASPO, or to one of the measures provided for in Law No. 1423 of 27/12/56 (so-called preventive measures), or

- those who have been convicted, even at first instance, of so-called stadium offences (exclusion applies for five years). In this case, if a DASPO has already been served for the same incident, the five-year exclusion period is subtracted from the period already served for the DASPO itself.

7. Conclusion of the Contract

The Contract shall be deemed concluded and binding between the Holder and the Club once the relevant procedures have been completed (online or at the Unipol Domus Ticket Service) and payment of the fee has been made.

8. Execution of the Contract

The Holder's personal data must be correct and truthful. The processing of such data will be carried out in accordance with the terms of the information notice also available on the Site, which you must read and accept in order to subscribe to the Card. If necessary, the Holder may proceed to amend the data provided at registration by sending an e-mail to privacy@cagliaricalcio.com.

9. Prohibition of Transfer

The PASSIONE CASTEDDU card is strictly personal and non-transferable.

10. Cases of suspension or interruption of the PASSION CASTEDDU Card

10.1. The Cardholder accepts the unquestionable right of the Club to exclude or suspend the Card at any time, with the consequent invalidation of the Card's functionality and of all or some of the privileges attached to it, without this entailing the payment of any compensation, including pro quota, restitution of the consideration paid or indemnity, in respect of those persons:

- who, in the opinion of the Club, or upon report by the police or Cagliari Calcio's partner companies, have behaved in a manner that is not compliant with the Code of Regulations and/or the Unipol Domus Regulations, as well as, in general, behave in a manner that is detrimental to Cagliari Calcio. In this regard, the Holder expressly acknowledges and accepts that the Club, in compliance with the Regulatory Code, may carry out investigation and control activities against him/her in order to prevent and sanction certain conduct prohibited by the Regulatory Code. Furthermore, the Holder expressly acknowledges and accepts that the sanctions provided for by the Regulatory Code may consist, by way of example but not limited to, in removal from ongoing matches and/or in the prohibition to purchase tickets and season tickets or to use the tickets and season tickets already purchased (without being entitled to receive any reimbursement) for one or more subsequent matches/seasons or in perpetuity, under the terms and according to the procedures provided for by the Regulatory Code.

- who have irregularly used or attempted to use the Card to gain fraudulent access to the stadium;

- in respect of whom it is established that they are subject to the measures referred to in Art. 6 of the law of 13 December 1989, no. 401, or referred to in Law no. 1423, or denunciation or conviction, even with a non-definitive sentence, for offences committed on the occasion of or by reason of sporting events;

- who have used the Card in the context of scalping activities;

- who have revoked and/or expressed opposition to the processing of personal data relating to the issue of the PASSIONE CASTEDDU Card;

- who have culpably (e.g. through negligent custody or delayed communication to Cagliari Calcio), or voluntarily, allowed another person to use (or attempt to use) the Card as a Stadium Access Ticket;

- who, following checks and verifications, including those carried out after the issue of the Card, are found to have provided untrue data (such as, purely by way of example and not limited to, a date of birth that differs from the actual date of birth) in order to circumvent the checks underlying the system for verifying the absence of grounds for refusal and/or to have made false statements concerning the absence of convictions and/or grounds for refusal to issue the Card;

- who, on the basis of objective elements, have been found to have engaged in conduct aimed at active participation in violent incidents at or on the occasion of sporting events or such as to endanger public safety at or on account of such events;

- which violate the provisions of Articles 9 (Prohibition of assignment) and 11 (Proprietary rights) of these Terms and Conditions.

10.2. By virtue of the provisions of the preceding paragraph, the Card may therefore be revoked or suspended for one or more official matches and become unusable as a stadium Access Ticket for that period, without the payment of any compensation, including pro quota, return of the consideration paid or indemnification.

11. Intellectual Property Rights

The Club shall not be liable for any injury or damage that may be suffered by holders of a Season Ticket purchased through other than authorised channels. The sale of the Season Ticket takes place through points enabled by TicketOne S.p.A. for the sale of the Season Ticket and managed by Cagliari Calcio S.p.A. and is governed by the present Terms and Conditions and, for all that is not provided for herein and where not in conflict, by the general terms and conditions published on the website www.ticketone.it/termini. Upon payment, the season ticket will be issued in print@home (PDF) mode or by digital upload to your loyalty card. Without exception to the provisions of art. 6 below, for the Holder the Season Ticket, once issued, is the only entitlement that legitimises the exercise of the right and the related access to Unipol Domus. The Season Ticket is strictly personal and, subject to change of the user's name, may be transferred to a third party provided that the same category of Season Ticket is used and only in the cases and under the terms indicated by the regulations in force, subject to the transferee's acceptance of the Regulatory Code, under the conditions set out below.

Art. 5. Card possession. Loss, theft or misappropriation of the season ticket.

The Card on which the season ticket is loaded, together with the personal identity document, is the only document that legitimises the exercise of the right and access to Unipol Domus. The Cardholder is obliged, by taking the utmost care, to ensure the safekeeping and proper use of the Card on which the season ticket is loaded and is therefore liable for all consequences arising from its use by third parties. In the event of loss, theft or misappropriation of the Card, the Cardholder is obliged to promptly report it to the competent authorities and notify the Club in writing.

The Holder therefore undertakes to (a) not to allow under any circumstances the use of Season Tickets by persons who are barred from entering sports facilities (and/or purchasing the relevant tickets); (b) not to use the Season Ticket for commercial purposes, speculation and/or scalping; (c) not to resell the seat or transfer their admission ticket to third parties, including through online sales platforms carrying out secondary ticketing activities.

Subject to the provisions of Articles 12 and 13 below, Season Tickets may be suspended for one or more official matches or for a specific period of time, and may also be permanently revoked and thus become unusable as a ticket for admission to the Unipol Domus, without this entailing the payment of any compensation, including pro quota, restitution of the price paid or indemnity, if the Holder has negligently or voluntarily allowed another party to use (or attempt to use) it as a means of access to Unipol Domus.

Art. 6. Sanctions for violations of the Unipol Domus Regulatory Code and Regulations.

By signing the season ticket, the season ticket holder declares that he/she has read and accepted the Unipol Domus Regulations and the Unipol Domus Regulations for the use of the Unipol Domus sports facility (hereinafter referred to as the "Unipol Domus Regulations"). The Unipol Domus Regulatory Code and Regulations will be posted inside Unipol Domus and will also be published on the Site. Compliance with these documents is an indispensable condition for spectators to enter and remain in the Unipol Domus (or other sports facility). Access to the Unipol Domus (or any other sports facility) may require the person concerned to undergo preventive and security checks on his/her person and in any accompanying bags and containers (to which he/she must submit), aimed exclusively at preventing the introduction into the stadium of objects or substances that are illegal, prohibited or likely to induce or provoke acts of violence. The Holder is required to comply with the provisions contained in the Unipol Domus Regulatory Code and Regulations. In the event of an ascertained breach of the provisions contained herein, Cagliari Calcio shall be entitled to adopt the sanctioning measures provided for by the Code of Regulations and the Unipol Domus Regulations, including, by way of example only:

- the removal of the spectator from the Unipol Domus;

- in the most serious cases, suspension or revocation and/or cancellation of the season ticket.

In the aforementioned cases of ascertained violation of the Code of Regulations, Cagliari Calcio also reserves the unquestionable right to refuse to contract with the offender in relation to the purchase of one or more tickets for one or more matches or for a specific period of time and/or in relation to the purchase of a season ticket for one or more subsequent seasons. Moreover, in the event of an ascertained breach of the provisions contained in the Unipol Domus Code of Regulations and Regulations, the offender may not be the recipient of a ticket or season ticket by other holders. Cagliari Calcio shall be entitled to retain as a penalty the consideration for the season ticket for unused matches.

Art. 7. Authorisation to use photographic and/or audio and video footage.

The Holder, having acknowledged that photographic and/or audio and video footage may be taken inside Unipol Domus, consents to being photographed, filmed or shot by the Club - and/or by any third parties appointed by it - which shall have the right to use, transmit, publish, disseminate, license without territorial or temporal limits, and without any obligation to pay money or any other form of consideration, the voice, image and portrait of the same by means of live or recorded video, with freedom of use on any support used for the fixation of the images and performances such as audio, video, photo, film multimedia supports, digital supports, television footage, magnetic supports and any other technological means currently known (including television, the Internet and/or other telematic networks) or that will be invented in the future, for editorial uses in relation to editorial initiatives carried out by the company's official communication organs (in any language published), for broadcasting on public, private and pay television, through the Internet and/or mobile applications, in cinemas and any other means of communication, for archive purposes, for the provision of services offered to the public for any reason and for promotional/advertising purposes, always respecting the rights to honour and reputation and within the limits set by current legislation.

Art. 8. Transfer of the season ticket to a third party.

Notwithstanding the fact that the Owner is prohibited from trading and/or speculating, reselling the seat, Cagliari Calcio, at its sole discretion, may allow the Owner to transfer its Season Ticket to third parties for single matches, in compliance with the provisions issued by the Club and only through the channels authorised by the Club itself and after providing the details of a valid identity document and health card of the new user, and after the acceptance of these Terms and Conditions, of the Code of Regulations and of the Information on the Processing of Personal Data. It is understood that this right to transfer admission tickets is in any case subject to any limits imposed, even on the occasion of individual matches, by the competent authorities. Unauthorised transfer of the season ticket and misuse of the name change system constitutes an illegal use. It is understood that the change of user procedure is only possible if it is carried out for the benefit of a Card holder with the same rights.

Art. 9. Season Ticket Price Reduction Hypothesis.

Cagliari Calcio may implement reductions on the season ticket price for certain categories of persons and/or in certain stadium sectors. The specific categories of subjects, the criteria for price reductions and the application modalities will be made known by Cagliari Calcio through the Club's communication media. It is understood that the Club shall be entitled to promote during the 2023/2024 football season any promotional sales aimed at new subscribers, without this entailing the payment of any compensation, including pro quotarefund of the price paid or compensation by those who have previously subscribed to a Season Ticket without being able to benefit from the aforementioned promotions.

Art. 10. Right of pre-emption.

Cagliari Calcio reserves the right to grant season ticket holders the right of first refusal on the purchase of season tickets for the following season, to be exercised within the deadline that will be communicated from season to season. After this deadline, the free sale of season tickets will begin.

Art. 11. Inability to attend the match due to facts not attributable to Cagliari Calcio.

In the event of the closure of the sector of the stadium in which the holder's seat is located, the holder - provided that he has not contributed to causing the Company's liability, not even on an objective basis - shall be entitled to reimbursement of the price, unless the Company provides him with a replacement ticket to attend the match in another sector of the stadium. In the event that the pitch is disqualified and the match is played at another stadium, or that the match is played behind closed doors, the Holder - provided that he has not contributed to causing the Company's liability, not even objectively - shall be entitled to reimbursement of the price or, at his choice, to a replacement ticket to attend the match at another stadium (subject to availability).

Cagliari Calcio also reserves the right to assign the holder a seat other than the one indicated in the season ticket in the event of renovation works, fortuitous events, public order and safety, for reasons arising from provisions of the Lega Calcio and/or provisions of Public Safety Authorities, the National Observatory on Sporting Events, CASMS or any other competent body or due to changes in Federal Regulations, also following a specific request by the Public Safety Authorities. In such cases, the Holder shall also not be entitled to any reimbursement.

It is understood that any reimbursement that may be due by Cagliari Calcio, as a consequence of potential defaults attributable to it, shall be due to the Holder pro quota only for the portion of the season ticket that has not been used due to facts and/or events for which Cagliari Calcio shall be directly responsible, in accordance with the procedures identified by the Club.

The Holder acknowledges that any changes to the calendar, as well as the possible cancellation and postponement of a competition, with the consequent modification of the date, time and possibly the venue, must be considered as part of the normal organisational practice of sporting events and in any case are to be understood as possible and eventual situations for which the Holder accepts the risk that they may occur. These changes must therefore be taken into account by the Holder when purchasing the season ticket. The Holder therefore has the duty to inform himself and update himself in good time as to the actual day, time and place of the home games.

Art. 12. Abuse and/or fraudulent and/or improper use of the Season Ticket.

Any abuse and/or fraudulent and/or improper use of the Season Ticket, within the meaning of the law and these Terms and Conditions, will result in its immediate withdrawal and/or blocking and/or deactivation, revocation and/or cancellation and may also result in the Club refusing to contract with the offender in relation to the purchase of one or more tickets for one or more matches or for a specific period of time and/or in relation to the purchase of a Season Ticket for one or more subsequent seasons. Furthermore, in the event of ascertained abuse and/or fraudulent and/or undue use of the Season Ticket, in accordance with the law and these Terms and Conditions, the offender may not be the recipient of a transfer of the season tickets by other holders.

Art. 13. Sanctions.

Cagliari Calcio also reserves the unquestionable right to apply the sanctioning measures provided for in the Unipol Domus Code of Regulations and Regulations, at any time, in the event of (a) grounds for revocation of the Card for the Cardholder; b) breach by the Holder of the Regulatory Code and/or the Unipol Domus Regulations and/or art. 6 of these Terms and Conditions; (c) unlawful conduct on the part of the Holder, contrary to law, public order or morality, as well as acts of violence and/or racism against persons and/or things; (d) prohibition of the transfer of the access pass referred to in Art. 8.

Art. 14. Exclusion of the right to reimbursement of the purchase price of the season ticket.

In the cases provided for in Articles 12 and 13 above, the Season Ticket Holder shall have no right to reimbursement, not even pro quota, nor to indemnity or compensation. Cagliari Calcio shall be entitled to retain as a penalty the consideration for the season ticket for unused matches.

Art. 15. Validity.

The Season Ticket is valid for one sporting season (according to the regulations in force from time to time) starting from the first home game following the issue of the Season Ticket.

Art. 16. Issuance of season tickets to persons residing in the region of the visiting team.

The issuing of season tickets to persons residing in the region of the visiting team may be subject to the possession of a loyalty card issued by the visiting team. In this case, if the resident in the region of the visiting team is without the aforementioned loyalty card, the season ticket will not be issued or will be cancelled, deactivated or invalidated, without the right to a refund.

Art. 17. Processing of Personal Data.

By purchasing the Season Ticket, the Holder declares that he/she has read and accepted the Information Notice on the Processing of Personal Data published at www.cagliaricalcio.com.

Art. 18. Exclusion of the right of withdrawal

As the provision of services relating to leisure time is covered by Art. 59 paragraph 1 letter n) of the Consumer Code (Legislative Decree 206/2005 ff.), the right of withdrawal referred to in Art. 52 et seq. of the Consumer Code.

Art. 19. Changes and Communications.

Cagliari Calcio reserves the right to amend the Terms and Conditions at any time with immediate effect, even for those who have already obtained a season ticket, in the event of subsequent legislative changes and/or the issue of measures by the Public Authorities. Notifications of changes shall be made via the Site or by e-mail, by sending an SMS message with an invitation to consult the changes on the Site, or otherwise in writing.

Art. 20. Applicable Law and Jurisdiction.

These Terms and Conditions are governed by Italian law and by federal regulations. For any dispute relating to the validity, formation, conclusion, interpretation, execution and termination of the aforesaid Terms and Conditions, the exclusive competent court shall be that of Cagliari, or that of the place of residence or domicile of the Holder, if the latter qualifies as a "consumer" pursuant to the Consumer Code.
